Civil Procedure Rules October 2022 updates
The Civil Procedure Rules amendments that come into force on 1 October 2022 has limited impact on costs. Those costs related changes include amendments to Part 46, whereby the IPEC scale costs will be moved from Part 45 (fixed costs) to Part 46 (Costs – Special Cases). There has been an amendment to CPR38.3(5) to draw users’ attention that a Notice of Discontinuance must be in the prescribed form. The Disclosure pilot scheme in the Business and Property Courts is here to stay and will be incorporated into the substantive Rules as a permanent practice direction under Part 57A.
