Some interesting cases

  • CALDERO -v- BEPPLER & JACOBSON LTD & ORS (7) KC -v- PETERBOROUGH & STAMFORD HOSPITALS NHS FOUNDATION TRUST – The claim concerned the failure to identify an obstetric anal sphincter injury following the delivery of her child. – Liability was disputed for some 32 months before a 75/25% liability agreement was reached. Quantum eventually settled just two months before trial. – The claim settled in the sum of £135,865.86, i.e. nearly £182,000 on a full liability basis. – The Budget was approved in the sum of £171,670.00. – The Bill totalled £273,684.91, including additional liabilities. – 100% Success Fee allowed as claimed. 1% and 2% Budget costs exclusive of Success Fee. – Grade A fee earners rates allowed as claimed (£250-£290). – Following a 3 day assessment the Claimant beat her own Without Prejudice offer and costs of assessment on the 3rd day only were awarded on the indemnity basis. – Including interest and costs of assessment the total costs recovered were £262,889.49.
  • RS -v- CAMBRIDGE UNIVERSITY HOSPITALS NHS FOUNDATION TRUST – The claim concerned a hysteroscopy and the failure to stop the procedure upon the requests of the Claimant. – Liability was disputed for some 59 months before a settlement was reached with no formal admission. – The claim settled in the sum of £15,000. – The Budget was approved in the sum of £158,873.20. – The Bill totalled £213,261.50, including additional liabilities. – 85% Success Fee allowed as claimed. The 1% and 2% Budget costs exclusive of Success Fee. – Grade A fee earners rates allowed at £240. – The costs were considered proportionate to the issues at hand. The figure of £70,000 was considered to be the sums in issue for the purpose of proportionality. – Following a 2 day assessment the Claimant beat her own Part 36 offer and the additional 10% award, enhanced interest and indemnity costs were awarded. – Including interest and costs of assessment the total costs recovered were £194,880.77.
  • JC -v- HINCHINGBROOKE NHS FOUNDATION TRUST – The claim concerned the failure to identify and repair an obstetric anal sphincter injury following the delivery of her child. – The claim settled in the sum of £200,000, 6 months before Trial. – Claim not subject to any Costs Management Order. – The Bill totalled £306,789.82, including additional liabilities. – 100% Success Fee allowed as claimed. The 1% and 2% Budget costs exclusive of Success Fee. – Grade A fee earners rates allowed at £250, £263 and £276. – Following a 2 day assessment the Claimant costs were assessed in the sum of £265,934.73 including interest and costs of assessment.
